1. Acceptance of Terms

By accessing or using Poppify ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Poppify is a social media management platform that helps users:

• Schedule and publish content to Instagram, TikTok, YouTube, and Facebook
• Generate AI-powered content suggestions
• Analyze social media performance and metrics
• Manage multiple social media accounts
• Convert user-uploaded photos into short-form videos with music, transitions, and AI-generated captions, delivered as a downloadable file (available as one-time purchases, including through agentic commerce platforms such as ChatGPT, Gemini, and Claude)

3. Account Requirements

• You must be at least 13 years old to use the Service
• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You must have the right to connect the social media accounts you authorize

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Post spam, misleading, or harmful content
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to the Service
• Violate the terms of connected social media platforms

5. Content Ownership

• You retain ownership of content you create and publish through the Service
• You grant Poppify a license to process your content to provide the Service
• AI-generated suggestions are provided as recommendations; you are responsible for content you publish

6. Third-Party Platforms

The Service integrates with third-party platforms (Instagram, TikTok, YouTube, Facebook). Your use of these platforms is subject to their respective terms of service. Poppify is not responsible for:

• Changes to third-party platform APIs or policies
• Actions taken by third-party platforms on your account
• Availability or functionality of third-party services

7. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice when possible.

8. Limitation of Liability

To the maximum extent permitted by law, Poppify shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

9. Termination

We may terminate or suspend your account if you violate these terms. You may delete your account at any time by contacting us.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.

11. Purchases Through AI Agents and Agentic Commerce

You may purchase Poppify services through AI agents and agentic commerce platforms, including but not limited to OpenAI's ChatGPT (via the Agentic Commerce Protocol), Google's Gemini (via the Agent Payments Protocol), Anthropic's Claude (via Model Context Protocol), and similar AI assistants.

• Authorization. When you direct an AI agent to purchase a Poppify service on your behalf, you authorize that agent to act as your agent for the purpose of completing the transaction, including providing payment authorization and accepting these Terms.
• Confirmation. Agent-initiated purchases require explicit user confirmation at the point of purchase. Poppify will not deliver a paid service unless the agentic commerce platform confirms that the user has authorized the specific purchase amount and item.
• Identity and contact. Where the agentic platform provides a buyer email or contact identifier, that identifier is treated as the customer of record for the transaction, including for receipts, refunds, and dispute correspondence.
• Delivery. Services purchased through agentic platforms are delivered as a downloadable file (or equivalent digital deliverable). Poppify does not auto-publish content to third-party social platforms for agent-initiated purchases unless the user has separately connected their accounts.
• Refunds and disputes. Refunds for agent-initiated purchases follow the Refund Policy and may additionally be subject to the rules of the agentic commerce platform through which the purchase was made.
• Limits. Poppify reserves the right to decline, cancel, or refund any agent-initiated purchase that we reasonably believe was made without proper user authorization, that violates these Terms or our AI Content Policy, or that exhibits indicators of fraud or abuse.
